1. Introduction

Welcome to WallabyX. These Terms of Service ("Terms") govern your access to and use of the WallabyX platform and website located at https://wallabyx.com (the "Service"), operated by Denis Franchi ("we", "us", or "our"). By registering for or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Service.

2. Beta Access

WallabyX is currently in public beta, open to anyone who registers. Access during this phase is provided free of charge. Beta access will remain open until we reach 50 registered users, after which registration may be limited or subject to a waitlist. As a beta user, you acknowledge that: • The Service is still under active development and may be incomplete, unstable, or subject to significant changes • Features, functionality, and these Terms may change at any time without prior notice • We do not guarantee uninterrupted availability or data preservation during the beta phase • Beta access may be revoked at any time at our sole discretion When WallabyX exits beta and introduces paid plans, updated Terms of Service will be published. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.

3. Account Registration

To access WallabyX, you must register for an account. You agree to: • Provide accurate, current, and complete information during registration • Maintain the security of your account credentials and not share them with third parties • Notify us immediately at info@wallabyx.com if you suspect unauthorized access to your account • Take full responsibility for all activity that occurs under your account You must be at least 18 years old to use the Service. By registering, you confirm that you meet this requirement.

4. Subdomains

SUBDOMAIN ASSIGNMENT

WallabyX allows users to create websites on subdomains of wallabyx.com. When registering a subdomain, our system applies automated filters to block names that are clearly offensive, misleading, or violating ethical standards. However, we do not guarantee that all inappropriate names will be intercepted at the time of registration.

OUR RIGHTS OVER SUBDOMAINS

We reserve the right, at our sole discretion and without prior notice, to: • Suspend or permanently remove any subdomain that violates these Terms or applicable law • Reclaim subdomains that are found to be offensive, misleading, impersonating third parties, or otherwise contrary to our ethical standards • Rename or redirect subdomains in cases of abuse or brand protection The assignment of a subdomain does not constitute a grant of ownership or any intellectual property right over the chosen name.

5. User Content

YOUR RESPONSIBILITY

You are solely responsible for any content you upload, publish, or otherwise make available through the Service, including text, images, files, and any other materials ("User Content"). By uploading User Content, you represent and warrant that: • You own the content or have the necessary rights and permissions to use and publish it • The content does not infringe any third-party intellectual property, privacy, or other rights • The content complies with all applicable laws and regulations

PROHIBITED CONTENT

Eccolo corretto e pulito: You agree not to upload or publish content that: Is illegal, fraudulent, defamatory, obscene, or harmful Promotes violence, hatred, discrimination, or illegal activities Infringes third-party intellectual property rights Is misleading, deceptive, or impersonates any person or organization Is unrelated to the stated purpose of the site or otherwise inappropriate Please note that WallabyX is a fully managed platform: all code, infrastructure, and execution environment are exclusively controlled by us. Users cannot upload or execute custom code. We monitor the platform and reserve the right to remove any User Content that, in our sole judgment, violates these Terms or our ethical standards, without prior notice and without liability to you.

6. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to: • Attempt to gain unauthorized access to any part of the Service or its infrastructure • Interfere with or disrupt the integrity or performance of the Service • Use the Service to send unsolicited communications or spam • Reverse engineer, decompile, or attempt to extract the source code of the Service • Use automated tools to scrape, crawl, or extract data from the Service without our written consent • Resell, sublicense, or otherwise commercialize access to the Service without our prior written approval

7. Intellectual Property

The Service, including its design, code, features, branding, and all related intellectual property, is owned by Denis Franchi and protected by applicable intellectual property laws. You retain ownership of any User Content you upload. By publishing content through the Service, you grant us a limited, non-exclusive, royalty-free license to host, display, and deliver that content solely for the purpose of operating the Service. WallabyX, Wally, and all related logos and trademarks are the property of Denis Franchi. You may not use them without prior written permission.

8. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, if we determine that you have violated these Terms or for any other reason at our sole discretion. You may terminate your account at any time by contacting us at info@wallabyx.com. Upon termination, your right to access the Service will immediately cease. During the beta phase, we may also discontinue the Service entirely at any time without liability.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. This disclaimer is especially applicable during the beta phase, where the Service is under active development and may experience instability, data loss, or unexpected behavior.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Denis Franchi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or in connection with your use of or inability to use the Service. Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid us in the twelve months preceding the claim — or zero, during the free beta phase.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Reggio Emilia, Italy.

12. Changes to These Terms

We may update these Terms at any time. If we make significant changes, we will notify you by email or via the platform. The "Last updated" date at the top reflects when the Terms were last revised. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. We strongly recommend reviewing these Terms periodically, especially when transitioning from beta to paid plans.
